Below are links to specific areas of interest in this section of the Help File to assist Impartial Hearing Officers (IHO) in using the Impartial Hearing Reporting System (IHRS). Use the navigation menu on the left of the screen to access all areas of the Help File.

IHO Responsibilities

Relevant New York State Regulation(s):

  •  8 NYCRR §200.5(i)(6) and (7)
  •  8 NYCRR §200.5(j)(3), (4) and (5)

The IHO is responsible for communicating all hearing related information to both parties. This communication includes but is not limited to:

  • Response to a request to rule on the sufficiency of a due process complaint,
    Please Note: there can be no challenge to the sufficiency of a due process complaint notice in an expedited hearing.

  • Response to a request to amend the due process complaint,

  • Scheduling of hearing dates and closure of the record,

  • Response to each request for an extension, in writing, to both parties. A suggested Case Extension form (PDF Icon PDF format - 83.1 KB) is available for IHOs to use to submit extension information to the school districts.

  • The IHO must render and mail his or her written decision to both parties no later than 14 days after the record close date or by the case compliance date, whichever occurs first.

  • Unless the local board of education and the parents agree otherwise, the IHO must render a written decision regarding pendency prior to determining any other issue relating to the evaluation, identification or placement of a student.

Accessing IHRS

You may access IHRS from any computer with access to the Internet by going to the State Education Department home page at www.nysed.gov and see Steps to Log On to IHRS (link opens in new window).

IHRS is available 24/7; however, technical assistance is provided only during regular business hours 8:30 A.M. to 5:00 P.M., Monday through Friday.

Accessing the Help File

Help Icons

The Help File is an online tool available to answer most questions regarding IHRS and is accessed by clicking on the Help icon located anywhere in the IHRS site. Other features related to the Help File include:

  • Tool Tips – Tool tip links are located on many IHRS screens that link specific areas to a relevant topic in the Help File.

  • Downloadable Forms – Forms are available on the Help File site, to download or use electronically, to assist the user in capturing information during the hearing process for data reporting in IHRS. A Quick Help guide in PDF format is also available for downloading. Go to Forms in the navigation menu to access all available forms.

  • Technical Assistance – Technical Assistance updates regarding IHRS are reported on the Help File site to inform users of new or revised features, technical assistance memorandums, and other helpful information to assist users in better understanding the system. Go to Technical Assistance in the navigation menu to access technical assistance information.

How to Obtain an IHRS Username and Password

The applications accessed through the NYSED Web portal contain critical and sensitive information, so access to the applications must be confidential and secure. A username and password is required before attempting to access IHRS.

If you do not have an IHRS username and password you may contact the Office of Special Education by phone: 518-473-0170 or email: specedih@mail.nysed.gov

If after successfully logging on and clicking on the IHRS Main Menu you find that the IHRS menu selections are not visible, you may not be entitled to the IHRS application. Please contact the Office of Special Education for entitlement access to IHRS if you experience this problem.

About Usernames and Passwords

A username will consist of your first name and your last name with a period in between and is not case sensitive. A temporary password of eight characters that include random letters and numbers will be assigned to you and is case sensitive. For example:

Username: jane.doe
Password: pas12wrd

Assigned Access

After you have received your username and password the Office of Special Education will entitle you to access the IHRS application.

Your username determines what information you are allowed to view and which functions you are allowed to perform in IHRS.

Example:

Individual IHO users are allowed to view case information for their cases ONLY. They have no access to cases for other IHOs.

Three Tries Only

A user has three (3) attempts to log in. If you are not successful on the third attempt, your password is disabled and you are prevented from logging on in the future. Please contact the Office of Special Education by phone: 518-473-0170 or email: specedih@mail.nysed.gov to request your password be reset.

Steps to Log On to IHRS


Step 1.

Open your browser application (i.e., Internet Explorer or Netscape Navigator).

Step 2.

Type http://www.nysed.gov in the Address/Search field on the browser tool bar at the top of the window and press Enter or click Go.

Click the tab for the NYSED Business Portal page in the navigation menu at the top of the screen.

Click the Log On link in the upper right corner of the NYSED Portal page.

Type in your Username and Password in the respective fields on the Sign In screen.

Please Note: If this is your first time logging on to IHRS or your password is reset by the Office of Special Education you will be prompted to enter your old password and a new password. Enter the temporary password assigned to you by the Office of Special Education in the Old Password field. Enter a password you will remember that is eight characters long consisting of both alpha and numeric characters in the New Password field. Enter the password you have created again in the Confirm New Password field.


Step 6.

Click OK.

Note: If you receive a Security Alert pop-up message, click on Yes.

You are now logged on. The portal page returns with your username inserted in the Welcome banner and the Log On link in the upper right corner of the Application Portal menu bar has changed to Log Off.

Step 8.

Click IHRS Main Menu in the “My Applications” box. You will be directed to the IHRS Main Menu screen where you will be able to access your case information and find cases you are assigned to.

If the IHRS menu selections (e.g., IHRS Case Information, IHO Toolbox, etc.) are not visible after successfully logging on and clicking on the IHRS Main Menu this may indicate that you are not entitled to the IHRS application. Please contact the Office of Special Education for entitlement access to IHRS if you experience this problem. See How to Obtain an IHRS Username and Password for more information.

How to Troubleshoot Log On Problems

Use this chart to diagnose and solve problems that occur when you are trying to access IHRS.

Description of Problem

Action to Take

You get a message saying you cannot access your local area network.

This is a local problem. Contact your Network Administrator for assistance.

You get a message saying you can’t establish a connection to your internet service provider.

Can you access web pages other than NYSED?

If no, contact your Network Administrator or Internet Service Provider.

If yes, check what you have typed in the Address field. Re-type the URL correctly and press Enter or click Go. If the website still does not open, call the Office of Special Education at 518-473-0170 for help.

You get an error message: “Access denied.”

You are not logged on. Return to the NYSED Applications Business Portal screen and click Log On or click on the “Login” icon at the top left corner of the IHRS Main Menu screen. (IHRS will automatically log you out if there has been no screen action for 60 minutes.)

The menu selections on the IHRS Main Menu screen does not appear.

  • You are not logged on, return to the NYSED Applications Business Portal screen and click Log On or click on the “Login” icon at the top left corner of the IHRS Main Menu screen.

  • You are not entitled to access IHRS. Contact the Office of Special Education for access to the IHRS application.

You get an error message: “Error: Authentication failed. Please try again.”

  • Your Log On has failed. Check what you have typed in the Username field. Correct as necessary.

  • Click in the Password field and press the Delete key to clear the field. Re-type your password and click OK. Note: Passwords are case sensitive, check to see if your Caps Lock is on.

You get an error message: “Error: Authentication failed. Please contact your System Administrator.”

You have reached the limit of password attempts allowed by the system. Contact the Office of Special Education to reset your password. See Resetting Password for more information.

Change Password

Passwords expire after 180 days. You will be notified during the log on process when it is time to change your password. Follow the on-screen instructions. If you forget your password or have attempted to log on too many times and are locked out of the system, please contact the Office of Special Education to have your password reset and follow the instructions in Steps to Log On to IHRS with Reset Password.


Steps to Change Password

Perform this procedure when you first log in and when you are notified to do so.


Step 1.

Log onto IHRS. If your password has expired, skip to Step 3.


Step 2.

Click on Change Password at the top right corner of the Application Portal menu bar

With the Manage My Password window open, type your old password in the Old Password field.

Step 4.

Type your new password in the New Password field.

Step 5.

your new password again in the Confirm New Password field.

Click Submit.

Step 7.

A “Password Change” screen appears indicating that the password is successfully changed. If this does not occur, the resulting error message will provide guidance about next steps.

Click Done, you will be brought back to the Application Portal Page as logged on. The next time you log in, you may use the new password.

Resetting Password

Contact the Office of Special Education by phone: 518-473-0170 or email: specedih@mail.nysed.gov to have your password reset. Once you have received your temporary password by email follow the steps below:

How to Log Out of IHRS

From any screen in IHRS, click the Logout icon in the upper or lower right corner of the navigation menu. You will be returned to the Portal page. Your username has been removed from the Welcome banner and the Log Off link on the Application Portal menu bar has changed to Log On.

    The Office of Special Education Responsibilities Regarding Timelines

    The Office of Special Education monitors the timeliness of impartial hearing officer appointments and the timeliness of decisions on a daily basis.

    Late Appointment Monitoring

    The district has a responsibility to enter an impartial hearing request immediately upon receipt and to initiate appointment of a hearing officer not later than two business days after receipt of the request. Failure to appoint a hearing officer or failure to enter the appointment data in IHRS results in the following:

    • Initial notification to the school district superintendent and director of special education/pupil services that the appointment is overdue.

    • Second notification to the school district superintendent and director of special education/pupil services that the appointment continues to be overdue if after the initial notification the district has still not appointed an IHO.

    • Contact with the superintendent to review the activity with district staff and to set a timeline to address the late appointment, a letter is sent to the superintendent to confirm the agreed upon timeline.

    • A district's failure to appoint an IHO in accordance with regulatory timelines results in a notification of noncompliance to New York State Education Department’s Special Education Quality Assurance (SEQA).

    Late Decision Monitoring

    The district has a responsibility to enter the complaint issues, hearing data, extension data and other case information as it occurs. The case information in IHRS is reviewed daily to ensure compliance with the required regulatory timelines. SED monitors these timelines and notifies the district and IHO of cases that appear to be late. The notification processes include:

    • An initial notification of a late decision is sent to the school district superintendent, director of special education/pupil services and the IHO when a case is open and the compliance date (the date the decision is due) of a case has passed.

    • A second notification of a late decision is sent to the school district superintendent, director of special education/pupil services and the IHO when the initial notification was unsuccessful and the case remains out of compliance.

    • The Office of Special Education contacts the district representative, noted on the case, when the initial and second notifications are unsuccessful and the case remains out of compliance. If it is found that the reason the case appears late is due to district failure to enter the case data in a timely or appropriate manner the following steps occur:

      • Technical assistance is provided to the district to address the data entry issue. A date for correction of the issues is established with the district. If the correction is not completed by the agreed upon date the district may be contacted again.

      • If the case continues to appear out of compliance, and the contact with district staff has proven unsuccessful, the Office of Special Education contacts the school district superintendent to review the district responsibility on the case and determine a date for correction. A letter is sent to the superintendent documenting the date for correction and outlining the non-compliance issue(s). The SEQA Regional Associate (RA) and RA supervisor receive a copy of the letter.

      • If the issue is not corrected by the date identified in the letter to the superintendent and the case continues to appear out of compliance the district is referred to SEQA for corrective action.

    • When the contact with the district determines that the reason the case appears late is due to the IHO’s failure to render a decision in a timely manner, the Office of Special Education will contact the IHO to correct the issue. When contact with the IHO fails to correct the noncompliance the Office of Special Education uses a series of Noncompliance Alerts/Notification emails with the IHO. Failure to respond to the Alert/Notifications by bringing the case into compliance with Section 200.5(j)(5) of the Regulations of the Commissioner of Education, may result in an order from the Commissioner to render the decision or other action as outlined in Section 200.21(b) Procedures for suspension or revocation of impartial hearing officer certification.

    Timelines for Impartial Hearings

    The timeline for an impartial hearing case begins when the district receives a written due process complaint notice (impartial hearing request) from the parent for an impartial hearing or the school district initiates an impartial hearing. The table below identifies the number of days by which certain activities are expected to be completed.

    When a parent files a due process complaint notice, the hearing or a pre-hearing conference begins within the first 14 calendar days after:

    • the date the IHO receives parties' written waiver of resolution meeting;
    • OR

    • the IHO receives the parties' written confirmation that a mediation or resolution meeting was held but no agreement could be reached;
    • OR

    • the expiration of the 30-day resolution period,

    Whichever occurs first, unless the parties agree in writing to continue mediation at the end of the 30-day resolution period in which case, the hearing or pre-hearing conference shall commence within the first 14 days after the IHO is notified in writing that either party withdrew from mediation.

    Not later than 45 calendar days from the date required for commencement of the hearing.

    In cases where extensions of time have been properly granted beyond the applicable required timelines, the decision must be rendered and mailed no later than 14 calendar days from the date the IHO closes the record.

    CPSE

    Not later than 30 calendar days from the date required for the commencement of the hearing; or after the initiation of such hearing by the board of education.

    In cases where extensions of time have been properly granted beyond the applicable required timelines, the decision must be rendered and mailed no later than 14 calendar days from the date the IHO closes the record.

    Expedited

    An expedited due process hearing must occur within 20 school days of the date the complaint requesting the hearing is filed.

    Within 10 school days after the hearing ends.

    No extension to an expedited hearing timeline may be granted.


    *

    Commencement of a hearing means the first hearing date or pre-hearing conference.

    Decision Issued means date the IHO renders a decision and provides a copy of the decision to the parents, the board of education and to the State Education Department.

    Other Timelines Associated with the Impartial Hearing Process

    • The district must allow an IHO 24 hours to respond to a district contact regarding availability to serve as an IHO.

    • In order to ensure that the timelines are accurately implemented, the district is responsible for notifying the IHO when:

      • Both parties have agreed, in writing, to waive the resolution process or agree to use mediation to resolve the dispute.

      • Both parties agree, in writing, to continue mediation at the end of the 30-day resolution period or either party has withdrawn from mediation.

      • Both parties have executed a written settlement agreement during the resolution period and are closing the case as settled.

    • Additional hearing information must be disclosed by each party to all other parties not less than 5 business days prior to the commencement of a hearing.

    Definition of IHRS Dates Used to Monitor Timeliness

    Resolution Period End Date will be the same as the Resolution Compliance Date if the full 30-day resolution session elapses.

    Resolution Period End Date may be any day between 1 - 30 if both parties agree to waive the entire or remainder of the resolution session.

    Amended Date

    Date a party files an amended due process complaint notice

    Amended Date is entered by the school district based on the date the party has filed the amendment.

    For a case with an amendment occurring during the resolution session, the IHRS will extend the resolution period by 30 calendar days from the Amended Date. If the due process complaint notice for the impartial hearing is amended after the resolution period has ended, IHRS will insert a new resolution period using the Amended Date as the start date.

    Compliance Date

    Date the timeline for the impartial hearing ends and the final decision is due

    IHRS initially calculates the Compliance Date from the Resolution Compliance Date (except for expedited cases where it is calculated from the request date). The number of days added to the Resolution Compliance Date is based on the date required for commencement of the hearing: CSE - 45 days, CPSE - 30 days, Expedited 10 school days); In addition, the Compliance Date cannot fall on a holiday or weekend and is adjusted to the next business day automatically.

    IHRS adjusts the Compliance Date based on the following:

    • For cases with resolution sessions – entry of the Resolution Period End Date. See Resolution Period End Date above.

    • For cases with resolution sessions – entry of an Amended Date. See Amended Date above.

    • For expedited cases – entry of a hearing date. Compliance Date is set to 10 school days after the latest hearing date.

    • For expedited cases – entry of an extension. No extension is allowed.

    • For non-expedited cases – entry of an extension. Adjustments based on the regulations (maximum of 30 days, no more than 14 days between record close and decision date (when the decision is mailed).

    Extension Requested Date

    Date one of the parties requests an extension

    Extension Requested Date is received from the IHO and entered by the district as received.

    Extension Decision Date

    Date the IHO determines if the requested extension is granted or not

    Extension Decision Date is received from the IHO and entered by the district as received. This date maybe different from the Extension Requested Date because this date determines whether the extension is granted within the appropriate timeframe.

    New Record Close Date

    Date the IHO determines all materials must be submitted and the record is closed

    Is received from the IHO and entered as received by the district.

    The New Record Close Date may be no more than 14 days before the New Decision Date.

    New Decision Date

    Date the IHO determines the decision will be rendered

    Is received from the IHO and entered by the district as received. This date is often the same as the Compliance Date but not always. They are not the same if the IHO incorrectly granted an extension that is greater than 30 days or if there is more than 14 days from the new Record Close Date to the New Decision Date. In both instances, the Compliance Date is recalculated to conform to regulatory requirements by IHRS.

    Previous Compliance Date

    Date the decision was due before the most recent extension was granted

    Displayed by IHRS based on previously granted extensions. This date and the Extension Decision Date are the parameters used to determine if the extension granted by the IHO is in the correct time frame period.

    IHO Toolbox


    Extension Calculator

    The Extension Calculator tool assists in calculating appropriate dates for an extension, per §200.5(j)(5)(i) of the Regulations of the Commissioner of Education.

    Steps to Using the Extension Calculator


    Step 1.

    Log onto IHRS.

    Step 2.

    Click on Extension Calculator under IHO Toolbox on the IHRS Main Menu.

    Step 3.

    With the Extension Calculator window open, you may enter either the IHRS Case Identifier or the District Case Number.

    Click Find.

    Step 5.

    The Current Time Line Information for the queried case will appear. This screen identifies the case number, district case number, request date, current compliance date and whether the case was previously extended. This screen also calculates the date in which a subsequent extension may be granted.

    The Calculate Extensions section allows you to enter the Length of Extension in Days to find out the appropriate new decision date or you may enter a proposed New Decision Date of an extension you are considerning granting.

    Step 6.

    Enter the length in days of the proposed extension in the Length of Extension in Days field.

    – OR –

    Enter the proposed new decision date in the New Decision Date field. You may click on the CAL link to access a pop-up calendar for your convenience.

    Step 7.

    Click Enter.

    Step 8.

    A Calculation Results screen will appear with the results determined by whether you entered information in the Extension in Length of Days field or New Decision Date field. The information entered on the previous screen will appear highlighted.

    The results will indicate the length of the extension, the new decision date and a range of possible new record close dates.

    Extension Form

This form was created to resemble the case extension entry section in IHRS to assist the district's data entry person to easily and timely transfer extension data to the case record. You may download the form, click in the entry fields, enter your information, save it under a new name and email to the recipient electronically.

    Extension - Greater than 30 Days

    Extension granted by IHO and entered by the district is more than 30 days

    8 NYCRR §200.5(j)(5)(i) indicates “...Each extension shall be for no more than 30 days...”

    • District enters the extension (New Record Close Date and New Decision Date) as provided by the IHO

    • IHRS accepts the extension but adjusts the Compliance Date

    • IHRS sends email notice to district and IHO indicating IHO granted an extension greater than 30 days and adjusts the Compliance Date to a maximum 30 days.

     

    • Check IHRS to determine the current Compliance Date and whether an extension is necessary

    • Calculate the 30 day maximum starting the day following the Compliance Date; allow the IHRS to make the adjustments for weekends and holidays

    • Use the Extension Calculator under IHO Toolbox on the IHRS Main Menu screen to verify extension calculations.

     

    Extension Not Accepted - Granted prior to appropriate time frame

    Extension Decision Date (date extension is granted) is prior to the Previous Compliance Date

    • Only one extension may be granted at a time.

    • Except for the first extension, extensions cannot be granted unless the Extension Decision Date is at least one day later than the maximum Previous Compliance Date on the case.

    • District enters the extension as provided by the IHO

    • IHRS rejects the extension and provides an error message that subsequent extensions cannot be granted unless the Extension Decision Date is at least one day later than the maximum Previous Compliance Date

     

    • Check IHRS to determine the Resolution End Date if an initial extension is being granted or the maximum Previous Compliance Date if a subsequent extension being granted.

    • Although extensions may be requested at any time, the extension decision date must be at least one day after the Resolution Period End Date for initial extensions or one day after the Previous Compliance Date for subsequent extensions.

    Extension is granted in order to accommodate settlement discussions.

    8 NYCRR §200.5(j)(5)(iii) “Absent a compelling reason or a specific showing of substantial hardship, a request for an extension shall not be granted because of school vacations, a lack of availability resulting from the parties' and/or representatives' scheduling conflicts, settlement discussions between the parties or other similar reasons. Agreement of the parties is not a sufficient basis for granting an extension.”

    • IHO and district often get an initial late case notification because the Compliance Date arrives and no settlement is reached.

    • IHO must get parties together to determine status of case

     

    • In prehearing conference determine if the case is actually ready for hearing.

    • While the parties may continue their settlement discussions the IHO must proceed with the case

     

    Hearing dates are scheduled beyond the Compliance Date

    There is no automatic adjustment of the Compliance Date because hearings are scheduled.

    • District and IHO receive late notification when Compliance Date passes

     

    • Check IHRS for Compliance Date prior to each hearing

     

    Extension is requested and granted to lengthen the timeline by the number of days between hearings sessions

    There is no need to extend the timeline of the case unless it is clear that the decision cannot be rendered by the Compliance Date. This practice simply enters multiple extensions and shortens the timeframes within which needed extensions can be granted

    • District enters the extension as provided by the IHO

    • The number of days between the Previous Compliance Date and the Compliance date is based on the length of the extension

    • Subsequent extensions may only be granted after the Previous Compliance Date

     

    • An “Adjournment “ is not equivalent to and extension. An extension is intended to move the Decision Due Date.

    • Confirm the Compliance Date in IHRS to determine whether an extension of the timeline is necessary.

     

    Extension Not Accepted - Did not extend the timeline

    Extension granted does not move the Compliance Date further into the future

     

    • District enters the extension as provided by the IHO and receives an error message indicating that the extension is not accepted because the extension does not extend the timeline

    • District and IHO receive email notifying them of rejection of the extension

     

    • Check IHRS for current Compliance Date and adjust new record close and new decision dates accordingly.

    List of Active Cases

    The List of Active Cases tool assists in querying all active cases to which an IHO is appointed. The list is grouped by cases in hearing process and cases in resolution session.

    Steps to Using the List of Active Cases


    Step 1.

    Log onto IHRS.

    Step 2.

    Click on List of Active Cases under IHO Toolbox on the IHRS Main Menu.

    Step 3.

    On the List of Active Cases screen, type in your IHO ID number or click on the List link and click on your IHO ID number listed in the IHO ID pop-up window. Please note: An IHO may only query cases he or she is appointed to.

    Step 4.

    Click Find.

    Step 5.

    A List of Active Cases will appear. The first list includes Cases in Hearing Process, the second list includes Cases in Resolution Session . Both lists are in ascending date order.

    On the Cases in Hearing Process list, the Resolution End Date field will display "N/A" if the request is district-initiated or it will appear blank if the district has not entered a resolution end date. The End of 14 days to Initiate Hearing date is calculated using the resolution end date entered by the district. If no date is entered a date will appear in italics, this date is based on the resolution compliance date and may change when the district enters a resolution end date. Expedited cases will have an "N/A" in the End of 14 days to Initiate Hearing field.

    Step 6.

    Cases in Hearing Process are listed in ascending order by Current Compliance Date

    Cases in Resolution Session are listed in acending order by Resolution Compliance Date.

    To access any of the cases appearing, click on the Case ID.

    Click on List located in the top navigation menu to return to the List of Active Cases results screen or click on Menu to return to the IHO Main menu.
